Hi, I’m Dennis I have a mountain home closing on Monday. I went for a final inspection and when I got there my agent said he received from the seller agent that the owner has clear dead for the land but not the home. The home was brought in as a modular home secured with a foundation added garage and driveway. The owner bought from a bank as a foreclosure 10 years ago and wasn’t given a deed. He did receive a statement from the bank saying that they have no financial interest in property and hold no leans. The owner said that was sufficient for him. Does this sound wonky to you? I’m angry this wasn’t brought up from the begining instead of 3 days before I have to be out of my current home three days before closing. The closing attorney says his statement from the bank is sufficient to protect my interest, My attorney says the statement is fine but the title or deed would be a better option,but a very lengthy process to search from records in the early 2000s. Have you ever had a situation like this,and if so how was it dealt with? I’m really in a no win situation! No where to go on Monday if don’t proceed with closing and no peace that the statement is 100 percent sufficient. The housing market in Atlanta is a ratio of about twenty five prospective buyers to every home on market. I had twenty nine offers on my current home in 7 days. I had no mortgage and it sold for 280,000 more then I paid for it 8 years ago.I have had seven homes under contract and each one ended up being a bidding war. I’m sorry but I’m afraid the market is going to take a dive at some point and I want to know my home will still be worth what I paid for it,so I just would not bid over a huge amount of the price. I Honestly I think the purchasers of my home have to be out of their minds going that much over. Sorry I know I go into to many details but I wake up and think about everything that could go wrong with this situation. ( My mom always called it stinking thinking ).
